ORDINANCE NO. 14, 2026
AN ORDINANCE OF THE CITY OF CATLETTSBURG,
KENTUCKY, ESTABLISHING REGULATIONS
FOR ABANDONED, VACANT, OR DETERIORATED
STOREFRONTS AND COMMERCIAL BUILDINGS
WITHIN THE DOWNTOWN DISTRICT; DECLARING
SUCH CONDITIONS A PUBLIC NUISANCE; REQUIRING
REGISTRATION, MAINTENANCE, AND
CORRECTIVEACTION;AND PROVIDING PENALTIESFOR
NONCOMPLIANCE.

SECTION 1. PURPOSE
The purpose of this ordinance is to protect the health, safety,
and economic vitality of the City of Catlettsburg by addressing
abandoned, vacant, or deteriorated storefronts and
commercial buildings in the downtown district. Such properties
contribute to blight, reduce property values, discourage
investment, and create public safety hazards.
SECTION 2. DEFINITIONS
For the purposes of this ordinance:
- "Abandoned Building" means any commercial
building or storefront that has been unoccupied for
180 consecutive days and shows signs of neglect,
deterioration, or code violations.
- "Vacant Building" means any commercial building
or storefront unoccupied for 90 consecutive days.
- "Downtown District" means the area designated by
the City of Catlettsburg as the central business
district.
- "Owner" includes any person, partnership,
corporation, or entity holding legal title.
SECTION 3. DECLARATION OF PUBLIC NUISANCE
Abandoned or deteriorated storefronts and buildings within the
downtown district are hereby declared a public nuisance when
they exhibit one or more of the following:
1. Broken or boarded windows
2. Structural deterioration
3. Accumulation of trash, debris, or overgrowth
4. Evidence of vandalism or unauthorized entry
5. Failure to maintain signage, awnings, or exterior
lighting
6. Conditions negatively aff ecting neighboring
businesses or public safety
SECTION 4. VACANT/ABANDONED BUILDING
REGISTRATION
Owners of buildings vacant for 90 days or more must register the
property with the City Clerk and provide:
- Current owner contact information
- Status of utilities
- Maintenance plan
- Intended future use or timeline for occupancy
A $50 annual registration fee shall apply.
SECTION 5. MAINTENANCE REQUIREMENTS
Owners of vacant or abandoned buildings must:
- Maintain windows, doors, and exterior surfaces
- Keep sidewalks and entrances free of debris
- Prevent water intrusion and structural decay
- Secure the building against unauthorized entry
- Maintain signage, lighting, and faQade appearance
- Remove graffi ti within 10 days of notice
SECTION 6. ENFORCEMENT AND PENALTIES
Failure to comply with this ordinance shall result in:
- First off ense: $100 fi ne
- Second off ense: $250 fi ne
- Each additional off ense: $500 fi ne
- Daily fi nes may accrue until compliance is achieved
The city may also pursue abatement, liens, or legal action as authorized
by Kentucky law.
SECTION 7. APPEALS
Property owners may appeal enforcement actions within 1 0 days
of notice of violation. The appeal should be submitted to the City
Clerk within 10-days of notice of violation. The City Clerk will
forward the appeal to the City Council at their next regularly
scheduled meeting to take action.
SECTION 8. SEVERABILITY
If any portion of this ordinance is found invalid, the remaining
sections shall remain in full force and eff ect.
SECTION 9. EFFECTIVE DATE
This ordinance shall take eff ect upon passage and pub - ation as
required by law.
