PUBLIC NOTICE
Federal regulations governing the Community Development
Block Grant (CDBG) prohibit confl icts of interest. The City of
Ashland, a CDBG-entitlement recipient, is responsible for identifying
situations in which a confl ict of interestÂ-whether real or
perceivedÂ-may exist. In accordance with 24 CFR 570.611, this
notice is a public disclosure of a possible confl ict of interest between
Commissioner Marty Gute and Salvation Army of Ashland,
the subrecipient of $80,000 for the program year beginning July
1, 2025 and ending June 30, 2026.
Commissioner Gute is also a board member for Salvation Army
of Ashland and has abstained from voting on the combined 2025-
2029 Consolidated Plan and 2025 Annual Action Plan Substantial
Amendment during the public commission meetings held on
November 20 and December 11, 2025. Copies of the minutes from
both meetings may be obtained from the City of AshlandÂ's Legal
Department or online at www.ashlandky.gov.
When a confl ict-of-interest waiver is required by the U.S. Department
of Housing and Urban Development (HUD), the City Attorney
issues a written opinion regarding whether the confl ict of
interest violates any federal, state, or local laws. If appropriate,
the City requests a confl ict-of-interest exception from the HUD
Louisville Field Offi ce. If approved, the Salvation Army of Ashland
will use CDBG funds for operating costs ($5,000) and to
construct a security partition wall with check-in area ($75,000).
